Conditional Certification Granted

On April 11, 2011, a federal district court in Minnesota conditionally certified a lawsuit by current and former Valspar Territory Managers claiming that Valspar has misclassified the Territory Manager position (formerly known as a Field Sales Representative) as exempt under the Fair Labor Standards Act and thus has failed to pay Territory Managers for all hours worked in excess of forty hours in a workweek, including the failure to pay overtime at a rate of one-and-one-half times the Territory Managers’ regular rate. Our firm, Cook Hall & Lampros LLP in Atlanta and the firm of Hunegs, LeNeave & Kvas P.A. in Minneapolis represent the Plaintiffs.
