On March 29, 2011, a federal district court in New York granted class certification to all persons or entities who reside in the United States and who contracted with Sirius Satellite Radio, Inc., XM Satellite Radio Holdings, Inc., Sirius XM Radio Inc. or their affiliated entities for the provision of satellite digital audio radio services. The Honorable Harold Baer, Jr., United States District Judge went on to hold that the antitrust violation will proceed to trial.
